Nursery Plants, Shrubs, Trees, & Sod Warranty

Definitive Landscapes & Concrete LLC guarantees exterior nursery shrubs, plants, trees, sod, and other plant material sold and installed by our company only to the extent that such material is covered by the supplying nursery’s warranty or guarantee.

If covered plant material dies or fails within the applicable nursery warranty period, Definitive Landscapes & Concrete LLC will replace the material with the same or a comparable variety and size, subject to the terms, conditions, and approval of the nursery’s warranty. No warranty or replacement will be provided for plant material that is not guaranteed by the supplying nursery.

In no event shall Definitive Landscapes & Concrete LLC provide a plant material warranty beyond the current calendar year of installation, regardless of the length of any nursery warranty.

Warranty Exclusions




The plant material warranty does not cover loss, damage, decline, or death resulting from conditions beyond the control of Definitive Landscapes & Concrete LLC. This includes, but is not limited to, improper or insufficient watering; overwatering; failure to properly maintain plant material; neglect; damage caused by pets, wildlife, insects, pests, or disease; herbicide or chemical damage; vandalism; construction or other activity occurring after installation; or extreme or unusual weather conditions, including excessive heat, drought, freezing temperatures, frost, wind, flooding, fire, or other acts of nature.


The customer is responsible for providing appropriate watering and ongoing care following installation. Plant material that is relocated, altered, removed, or maintained contrary to the care recommendations provided by Definitive Landscapes & Concrete LLC or the supplying nursery may not be eligible for replacement.


All warranty claims are subject to the terms, conditions, and approval requirements of the supplying nursery. Definitive Landscapes & Concrete LLC is not responsible for replacing plant material when the supplying nursery denies the warranty claim or when the material is otherwise excluded from the nursery’s warranty.


Any warranty is not applicable if PAYMENT IS NOT MADE IN FULL IN ACCORDANCE WITHIN THE TERMS OF THE ORIGINAL AGREEMENT with Definitive Landscapes & Concrete LLC.

 

Client Responsibility

 

  1. Recommended watering guidelines for all plants, trees, hydroseed and sod as per the Watering Guidelines for your new lawn and landscape
  2. Be sure your irrigation system is operating properly and notify Definitive Landscapes or your irrigation company immediately if you notice any problems with it.
  3. Pest Control. If not maintained by Definitive Landscapes, keep plants free of injurious animals, insects and diseases by timely and proper applications of pesticides.
  4. Keep plantings free of weeds.
  5. Notify Definitive Landscapes immediately if you notice any problems with your plants, shrubs, trees, sod or sprinkler system.

 

Hardscapes:

All materials are guaranteed under the manufacturer's warranty, and workmanship is guaranteed one year from installation.

Exclusions:

Discoloration of concrete based materials.


Irrigation Installation:

All materials are guaranteed for one (1) year from installation, and workmanship is guaranteed for one (1) year from installation, contingent upon proper system winterization, start up, and maintenance.


Water Features:

All materials are guaranteed under the manufacturer's warranty, and workmanship is guaranteed for one (1) year from installation, contingent upon proper system winterization, start up and maintenance.


Landscape Lighting:

All materials are guaranteed under the manufacturer's warranty, and workmanship is guaranteed for one (1) year from installation.


Concrete Curbing:

Your curbing has a one-year, one time replacement warranty against defects in materials and workmanship. Please refer to curbing care & warranty for further information.

Exclusions:

  1. Concrete curbing, like any other type of concrete, can and will crack. Although we attempt to control the cracking with additives and inserting expansion joints every couple of feet, occasionally a hairline crack will occur on the curb surface away from the control joint. A small number of hairline cracks are within tolerance and do not warrant replacement.
  2. Cracking for tree rings due to tree roots.
  3. Color variations in concrete, especially due to replacement.


Concrete & Overlays:

Workmanship is guaranteed for one (1) year from date of installation. Cracking in excess of 1/8” resulting from poor workmanship or use of substandard materials, shall be repaired or replaced.

Exclusions:

  1. Hairline cracks. Definitive Landscapes & Concrete, LLC makes no claim that hairline cracks might not develop, but ensures that every precaution is taken to minimize their occurrence by using approved methods and quality materials. A crack is a surface blemish only, it does not compromise the originally intended function, shape, or grade of the slab. Cracks are a natural consequence of exposure to the elements, and the curing process. There is no sure way to prevent or predict when and where a concrete slab may crack, and there is no minimum grace period or time limitation. A crack may appear within a day of a slab hardening, or after decades of undisturbed, unblemished surface.
  2. Slight surface imperfections, frost or freeze damage, salt damage and color variance.



Subcontractors:

All materials and labor are guaranteed by the subcontractor under the specific subcontractor's warranty for the service provided.


Blanket Exclusion:

ALL MATERIAL WARRANTIES AND LABOR GUARANTEES ARE VOID IF AN ACCOUNT IS NOT PAID IN FULL ACCORDING TO THE TERMS OF THE ORIGINAL AGREEMENT / CONTRACT.
